Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Gomgasht Workforce Health OS platform and related services ("Services") provided by Gomgasht Inc. ("Gomgasht," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

Acceptance of Terms

By creating an account or using the Services, you represent that you have the authority to bind your organization to these Terms. If you do not agree to these Terms, you may not access or use the Services.

License Grant

Subject to these Terms and payment of applicable fees, Gomgasht grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes during the subscription term.

Permitted Use

You may use the Services to:

• Conduct pre-shift wellness screenings for your workforce
• Manage triage workflows and return-to-work processes
• Monitor site readiness and environmental risk signals
• Generate aggregated workforce health and readiness reports
• Integrate with authorized third-party systems via our API

Restrictions

You agree not to:

• Use the Services to diagnose, treat, or provide medical advice
• Reverse engineer, decompile, or disassemble any part of the platform
• Share access credentials or allow unauthorized users to access the Services
• Use the Services in any manner that violates applicable law or regulation
• Attempt to circumvent security measures or access controls
• Use the Services to discriminate against employees or applicants

Data Ownership

You retain all rights in your data. Gomgasht does not claim ownership of any data you submit through the Services. We process your data solely to provide the Services as described in our Data Processing Agreement. Upon termination, you may export your data in standard formats within 30 days.

Confidentiality

Each party agrees to protect the other party's confidential information with at least the same degree of care it uses to protect its own confidential information, but no less than reasonable care. Confidential information includes all non-public technical, business, and operational information disclosed by either party.

Limitation of Liability

To the maximum extent permitted by applicable law, Gomgasht's total aggregate liability arising out of or related to these Terms shall not exceed the amounts paid by you in the twelve (12) months preceding the claim. In no event shall Gomgasht be liable for indirect, incidental, special, consequential, or punitive damages.

The Services are not a substitute for professional medical advice, diagnosis, or treatment. Gomgasht is not liable for health or safety outcomes resulting from use of the platform.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Dubai International Financial Centre (DIFC), without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the courts of the DIFC.

Modifications

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect by email or through the platform. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

Termination

Either party may terminate the subscription with 30 days written notice. Gomgasht may terminate or suspend access immediately if you breach these Terms. Upon termination, your right to use the Services ceases. Sections regarding data ownership, confidentiality, limitation of liability, and governing law survive termination.
